Kebijakan Publik Deliberatif Pemerintahan Desa: Catatan Legal-Historis Selama Implementasi Otonomi Daerah

Abstrak

Pasca reformasi, Pemerintah menjamin keterbukaan akses partisipasi publik masyarakat hingga level desa melalui berbagai produk hukum baik berupa undang-undang hingga peraturan pemerintah. Fakta problematiknya, terdapat fenomena pseudo partisipasi yang mencerminkan adanya persoalan dan tantangan yang perlu dibenahi. Regulasi existing yang selama ini mengatur tentang kaidah partisipasi publik tampaknya menjadi “macan kertas” pada aras proses. Hal ini disebabkan karena adanya gap antara kondisi ideal yang dikehendaki (ketentuan regulasi) dengan persoalan minimnya proses deliberasi dalam perumusan kebijakan publik di pusat maupun daerah. Kajian ini menemukan fenomena empiris bahwa terdapat persoalan ego dalam internal perumus kebijakan sehingga mempersempit ruang diskursus bersama publik dan stakeholder yang relevan. Beranjak dari kebermasalahan tersebut, perwujudan kebijakan publik deliberatif secara ideal membutuhkan daya tekan dan daya paksa sehingga mekanisme deliberasi dalam perumusan kebijakan publik dapat berjalan dengan optimal. Muaranya, proses perumusan kebijakan yang inklusif dan deliberatif akan menghasilkan kualitas kebijakan yang mendorong adanya perwujudan kesejahteraan masyarakat di desa.
