Abstrak

Indonesia has experienced a significant shift in legal politics regarding mass organization disbandment regulation. From a regulatory regime in which due process was strictly regulated to protect the right to association, to one in which due process guarantees are relaxed to allow the government to act quickly in the name of national security and public order. The purpose of this study is to analyze the current regulatory framework for the disbandment of mass organizations and to propose reforms to balance the government's interest in maintaining public order with the right to association. This research is normative in nature, employing statutory and conceptual approaches and secondary data gathered through a literature review. The findings of this study suggest that the Mass Organizations Law has several limitations and normative issues, including the removal of prior court authorization for disbandment decisions, the simplification of the administrative sanction imposition procedure, and the ambiguity surrounding the use of criminal offenses committed by mass organization members for the purpose of administrative sanction imposition. With the new low in the Constitutional Court's due process precedent, reforms may be made to reinstate the courts' role in the form of a speedy trial, by reinstating and calibrating temporal limitations on the imposition of sanctions, and by providing criteria for the use of criminal offenses as a basis for administrative sanctions. These reforms are necessary to ensure legal certainty and adequate due process, while also limiting and empowering the government in its efforts to maintain public order.
