Optimizing Village Governance: A Siyasah Dusturiyah Perspective on Law No. 3/2024

Abstrak

Artikel ini mengkaji revisi Undang-Undang No. 3 Tahun 2024 tentang Desa dalam perspektif siyasah dusturiyah (politik konstitusional Islam), dengan fokus pada peluang dan tantangan dalam optimalisasi tata kelola desa. Revisi ini memperkenalkan sejumlah perubahan, termasuk perpanjangan masa jabatan kepala desa, pengelolaan dana desa, dan mekanisme rehabilitasi infrastruktur. Melalui pendekatan studi pustaka, artikel ini menganalisis sejauh mana prinsip-prinsip siyasah dusturiyah, seperti keadilan (al-‘adl), transparansi (al-mas’uliyah wa al-muhasabah), musyawarah (as-shura), dan pemberantasan korupsi (mubarazah al-fasad), diimplementasikan dalam regulasi dan kebijakan yang baru. Hasil kajian menunjukkan bahwa revisi UU No. 3 Tahun 2024 memberikan peluang untuk memperkuat tata kelola desa yang adil dan akuntabel, sesuai dengan prinsip siyasah dusturiyah. Namun, tantangan dalam hal korupsi, ketimpangan pembangunan, dan partisipasi masyarakat masih perlu mendapatkan perhatian lebih. Sinergi antara pemerintah dan masyarakat serta penguatan mekanisme pengawasan menjadi kunci keberhasilan implementasi kebijakan ini dalam mencapai kesejahteraan desa yang berkelanjutan.
